Terms & Conditions
These Terms and Conditions (“Terms”) constitute a legally binding agreement between Creative World of Learning (“CWL,” “we,” “us,” or “our”) and the parent(s), guardian(s), or authorized representatives (“you” or “family”) enrolling a child in our program. By enrolling your child or using our services, you agree to these Terms.
CWL is a Gold-Rated childcare and early education provider operating under the Ohio Step Up to Quality program, serving the Dayton region and Miami Valley area. We are licensed by the State of Ohio in accordance with Ohio Revised Code Chapter 5104 and Ohio Administrative Code Chapter 5101:2-12.
1. Enrollment and Admission
Enrollment is subject to availability, completion of all required forms, and payment of applicable fees. CWL reserves the right to deny or terminate enrollment if, in our sole and reasonable judgment, we are unable to meet a child’s needs or if a family fails to comply with these Terms, program policies, or Ohio law.
Enrollment forms, including health and medical records, emergency contacts, and custody documentation, must be complete and current at all times. Families are responsible for promptly updating CWL whenever any enrollment information changes.
2. Ohio Licensing and Program Standards
CWL operates in full compliance with all requirements of the Ohio Department of Children and Youth (formerly ODJFS) governing licensed childcare centers, including:
- Staff-to-child ratios and group size requirements per Ohio Administrative Code § 5101:2-12-16
- Background check requirements for all staff under Ohio Revised Code § 5104.013
- Health and sanitation standards as prescribed by Ohio law
- Mandatory reporting obligations for suspected child abuse or neglect under Ohio Revised Code § 2151.421
- Fire safety, emergency preparedness, and building inspection requirements

3. Curriculum and Educational Programming
CWL uses the Creative Curriculum framework and Teaching Strategies GOLD assessment system to support each child’s academic, social, emotional, and physical development. Programming is designed to:
- Develop foundational academic skills through research-based, hands-on experiences
- Foster social collaboration and peer learning
- Build emotional intelligence through Conscious Discipline practices
- Support physical development through indoor and outdoor active learning
CWL reserves the right to modify curriculum, classroom assignments, activities, and program offerings at any time to maintain program quality and regulatory compliance.
4. Fees, Tuition, and Payment
Tuition rates, registration fees, and other applicable charges will be communicated to families in writing at the time of enrollment and updated as needed with advance notice. The following terms apply:
- Tuition is due on the schedule specified in your enrollment agreement. CWL reserves the right to assess late fees for payments not received by the due date.
- Enrollment fees are non-refundable unless otherwise stated in writing.
- Families receiving state childcare subsidies (including Ohio’s Child Care Assistance Program) are responsible for any co-pays and for maintaining eligibility. Loss of subsidy does not relieve the family of tuition obligations.
- Returned checks or failed electronic payments may be subject to a returned-payment fee.
- CWL reserves the right to suspend or terminate enrollment for accounts with outstanding unpaid balances.
5. Attendance, Drop-Off, and Pick-Up
For the safety of all children, the following attendance and pick-up policies apply:
- Only individuals listed as authorized on the child’s enrollment record may pick up a child. A valid, government-issued photo ID must be presented upon request.
- CWL staff will comply with custody orders and court documentation on file. It is the family’s responsibility to provide updated legal documentation. CWL is not liable for compliance failures resulting from the family’s failure to provide current documentation.
- Children not picked up by closing time may be subject to late pickup fees. If a child cannot be reached by authorized contacts within a reasonable time, CWL may be required to contact law enforcement or child protective services in accordance with Ohio law.
- Absences should be reported to the program in advance when possible.
6. Health, Illness, and Medical Policies
To protect the health of all children and staff, CWL enforces the following health policies in accordance with Ohio childcare regulations:
- Children must be current on all immunizations required by Ohio law (Ohio Revised Code § 3313.671) or have a valid exemption on file.
- Children exhibiting symptoms of communicable illness (including fever, vomiting, uncontrolled diarrhea, or rash of unknown origin) will be isolated and the parent or guardian will be notified for prompt pickup.
- Children must be symptom-free for the period required by Ohio law before returning to the program.
- Prescription medications may only be administered by staff with written authorization from the parent or guardian. All medications must be in original labeled containers.
- In a medical emergency, CWL staff will call 911 and contact the parent or guardian immediately. CWL staff are not responsible for decisions made by emergency medical personnel.
7. Behavioral Expectations and Discipline
CWL uses Conscious Discipline as its behavioral guidance framework. Our approach emphasizes positive reinforcement, emotional coaching, and community-building. CWL’s discipline practices are consistent with Ohio Administrative Code requirements prohibiting:
- Physical punishment of any kind
- Withholding food, rest, or bathroom access as discipline
- Emotional abuse, humiliation, or threats
CWL reserves the right to develop individualized behavior support plans in collaboration with families when needed. Persistent or serious behavioral concerns that pose a risk to the safety of other children or staff may result in program suspension or termination of enrollment, following notice and consultation with the family.
8. Mandatory Reporting
All CWL staff are mandatory reporters under Ohio Revised Code § 2151.421. CWL staff are legally required to report suspected child abuse or neglect to Ohio’s Public Children Services Agency (PCSA) or local law enforcement. CWL will not be liable for reports made in good faith pursuant to this obligation.
9. Limitation of Liability
CWL maintains all required insurance coverage and operates in compliance with Ohio safety and licensing standards. To the fullest extent permitted by Ohio law:
- CWL shall not be liable for illness, injury, or loss arising from circumstances outside of CWL’s reasonable control, including communicable diseases, acts of third parties, or emergencies.
- CWL’s liability for any claim shall not exceed the total tuition paid by the family in the thirty (30) days preceding the event giving rise to the claim.
- Nothing in these Terms limits CWL’s liability for gross negligence, willful misconduct, or as otherwise prohibited by Ohio law.
Ohio law governs liability for personal injury claims involving minors. Families are encouraged to maintain their own health and accident insurance coverage.
10. Media, Photography, and Intellectual Property
Separate written consent is required before CWL may use photographs or recordings of your child in any external-facing materials. CWL retains all rights to its name, logo, curriculum materials, and program content. Families may not reproduce, distribute, or use CWL’s materials for commercial purposes without prior written consent.
11. Termination of Enrollment
Either party may terminate enrollment with written notice as specified in the enrollment agreement. CWL reserves the right to terminate enrollment immediately for:
- Non-payment of tuition or fees
- Failure to comply with CWL policies or these Terms
- Conduct by a child, parent, or guardian that poses a risk to the safety or well-being of the CWL community
- Inability of CWL to meet a child’s care needs within available resources
Termination of enrollment does not relieve the family of any outstanding financial obligations.
12. Amendments
CWL reserves the right to amend these Terms and any program policies at any time. Material changes will be communicated to enrolled families with reasonable advance notice. Continued enrollment following notice of amendment constitutes acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Ohio without regard to conflict of laws principles. Any disputes arising from these Terms or your child’s enrollment shall first be subject to good-faith informal resolution between the parties. If informal resolution is unsuccessful, disputes shall be subject to the exclusive jurisdiction of the courts of the State of Ohio located in Montgomery County.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable under Ohio law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with the enrollment agreement and any written program policies provided to families, constitute the entire agreement between CWL and the enrolling family with respect to the subject matter herein, and supersede all prior discussions, representations, or agreements.
